The Kano Upper Shari’a Court has dismissed the case against Auwal Danladi Sankara, the suspended Jigawa Commissioner for Special Duties, accused of enticing a married woman, Tasleem Baba Nabegu.
Presiding Judge Mallam Ibrahim Sarki Yola terminated the case citing a lack of evidence, based on reports from the AIG Zone, Kano, and the Kano State Attorney General.
In his ruling, Judge Sarki Yola stated, “The decision to terminate this case follows a thorough examination by the AIG Zone, Kano, and the Kano Attorney General, which found no evidence to support the allegations of illicit affairs between Sankara and Nabegu.”
He further noted, “The police report and the submission from the Kano State Attorney General revealed that the allegations against the duo were not substantiated. Accordingly, the case is terminated.”
The Judge referenced Section 211 of the Constitution of the Federal Republic of Nigeria 1999 (as amended) and Section 364 (5) of the ACJL 2019 as the legal basis for his decision.6Nasir Buba, the complainant, was neither represented nor present during the court session.
Judge Sarki Yola emphasized, “There is no need for me to hear a response from the complainant since my action to terminate this case is based on the report of the AIG investigation and the Kano Attorney General’s findings tendered before the court.”
He also issued a caution to Hisbah officials and other law enforcement agencies, urging them to maintain professionalism in their duties. He stressed the need to avoid actions that could defame individuals’ public character.
